  • Overly complicated outfits/character designs might increase the original price from $10 USD up to $50 USD, depending on the design and the style chosen for the commissioned product. This applies at all times, for example, for all Genshin Impact characters wearing their original in-game outfits/costumes.

  • Props (weapons, vehicles, furniture, animals, etc.) start at +$7 USD, can go up to $50 USD on average, depending on their size, focus in the composition, and/or complexity.

  • Backgrounds start at +$25 USD, can go up to $75 USD on average depending on the complexity of the background, concept and/or composition. For sketches, backgrounds start at +$10 USD.

  • From the third character onwards, any extra character adds +50% to the couple base price unless stated otherwise. Complexity fees also apply on them.

  • Contact me privately regarding anything risqué.

  • Express delivery time fees are (sometimes, please ask before ordering) available for rendered pieces (1 to 2 weeks), flat colored pieces (1 day to 1 week), and sketches (4 to 48 hours). They depend on the urgency and complexity of the order, ranging from an additional +50%, up to +100% of the original price.

  • Commercial use for any purchase adds an additional +200% to the price total.

TERMS OF SERVICE


This Terms of Service Agreement ("Agreement") is entered into between me, the Artist, and you, the Client, for the commission of an artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:

♡ I. GENERAL

  1. I, as the Artist, reserve the right to refuse any commission application.

  2. By placing an application for a commission, you are allowing me, as the Artist:

  1. to define the scope of work, features, price, deliverables and other details for the project in a proposal in a format according to my, as the Artist, discretion which may include private message through networks including but not limited to ToyHouse, email, Discord, etc.;

  2. non-exclusive rights to observe and replicate your, as the Client, reference material for the use of the Work;

  3. warranty that the reference material provided to me, as the Artist, are legally obtained and authorised for use by you, as the Client;

  4. warranty that you, as the Client, have the authority to enter this agreement, be the point of contact and be solely responsible for decisions and approval during the process;

  5. warranty that you, as the Client, have provided me clear and complete requirements and expectations upfront, including reference materials or assets;

  6. indemnification against claims, losses, damages, and expenses related to Work usage by you, as the Client, breach by the Client of the Agreement, or third-party claims.

  1. All prices listed are merely a starting/base price per individual character/couple. Prices may fluctuate (either increasing or decreasing) depending on, including but not limited to, the complexity of your character's design, concept, and/or desired deadline.

  2. Any unused base sketches/thumbnails may be repurposed for other commissioned orders unless purchased by the Client.

  3. The details set forth by me, as the Artist, shall be agreed upon by you, as the Client, before the process of work begins.

♡ II. COMMUNICATION AND DELIVERY

  1. Turnaround time for the digital delivery of the Work stands, on average, at 2 weeks minimum, up to 2 months, depending on each project.

  2. Turnaround time relies and may increase depending on the complexity of the order, the commissioned style, and my, as the Artist, current workload, taking into account that 1) I have a main job in animation and 2) I may need to rest my hand due to health related issues.

  3. An approximate delivery date will be discussed and given to you, the Client, by me, the Artist, when your commission application is approved.

  4. Major delays and/or setbacks will be notified whenever possible.

  5. I, as the Artist, may reply within a ~48 hour timeframe, with less than 12 hours being the standard. If I take more than a couple hours to reply, by no means does this mean I’m ghosting you. If needed, please feel free to double ping me.

  6. If you, as the Client, stop replying to me halfway through the process for days on end without prior explanation, I will not continue working on the project until I receive an answer and will instead focus my attention on other clients and ongoing projects in the meantime. This does not mean your order will be cancelled unless you say so or if you completely ghost me.

♡ III. PAYMENT

  1. I take payment via PayPal, USD or MXN currency, via invoice method. Any form of payment sent before I invoice you will be refunded. Ask about other payment methods if required.

  2. Arranged payment must be sent in full upfront or after the sketch has been approved.

  3. I, as the Artist, will not continue working further from the sketch nor send any unwatermarked previews until the payment has been completed.

  4. Payment plants are only available for orders costing more than $100 USD, usually zero-interest, and will be invoiced accordingly.

  5. The Client counts with a 10-day period for the payment to be completed. If the Client doesn't go through with the payment within the required timeframe without any explanation, the slot will reopen and their commissioned order will be cancelled.

  6. No refunds allowed. The only exception is if I, as the Artist, find myself unable to complete your commission either due to skill or personal matters, in which case, you'll get a full refund.

♡ IV. COPYRIGHT: THE ARTIST'S RIGHTS

  1. The rights of each piece the Artist produces belong to the Artist, unless commercial rights have been bought. This means I, the Artist, am allowed to:

  • Show the final product in my portfolio.

  • Show the final product in my social media.

  • Show/stream the process of the commissioned order in my social media.

  • Use the final product as a public commission example to promote my work.

  • Repurpose unused process work for future projects, personal or otherwise.

  1. You, as the Client, may request for your order to remain private for an additional, negotiable privacy fee. This means I will not post the Work to any social media or public portfolio for as long as you, as the Client, require. The Work may still be used to display my skills privately.

  2. For perpetual exclusivity and privacy over the piece, meaning I as the Artist will not show it to any other party public or otherwise, an agreement with the Artist over the Work's privacy must be discussed prior and commercial rights must be purchased in addition to the privacy fee.

  3. In the specific case that commercial rights have been bought for any product(s), as the Artist, I am not allowed to:

  • Sell the final product as merch.

  • Profit off of the final product in any form.

  1. If at any time I, the Artist, were to break or disobey any of these clauses, you, the Client, are entitled to a full refund.

♡ V. COPYRIGHT: THE CLIENT'S RIGHTS

  1. You, the Client, are allowed to use the final commissioned product for personal use in any way you wish - by which I mean, as long as you do not profit / create merch / earn money off of the final product. Personal use may include: social media profile pictures/covers, layouts, wallpapers, personal website display, social media posts, physical prints and/or products that are not for sale or distribution to any other party, etc.

  2. You, as the Client, are entitled to be credited as the commissioner of the piece if requested and will be addressed by the name/handle you desire.

  3. Anonimity for you, as the Client, may be requested if desired.

  4. If the Client doesn't own the commercial rights over the final product, they are not allowed to:

  • Sell the finalized Work as merch.

  • Re-sell any part of the Work in any way.

  • Make monetary profit off of the Work in any way.

  1. Whether you've bought commercial rights over the final product or not, you, as the Client, are not, in ANY way, under ANY circumstances, allowed to:

  • Involve me, as the Artist, or my work, regardless of if it's the commissioned Work or not, in NFT/Crypto circles. My work isn’t intended to be used, sold, and/or minted as NFTs.

  • Use my work for AI training, or uploading my work (and/or your commissioned order) into any AI/Machine Learning service, be it for profit or merely personal entertainment.

  • Make large modifications - by which I mean anything beyond stickers, filters, color corrections, text, or very minor details, which are all okay - to the final product. Additional modifications need to be discussed with the Artist prior.

  • Claiming the commissioned Work as your, as the Client, creation.

  • Removing the Artist's signature from the finalized Work.

  1. If at any time you, the Client, were to break or disobey any of these clauses without reaching an agreement with me, I, the Artist, am entitled to not work again with you in any way, add you to my public blacklist and, if needed, issue a DMCA takedown notice (Digital Millennium Copyright Act).

♡ VI. WORKFLOW AND REVISIONS

  1. If you filled your application for a commission via form, I will reach out to you to the social media handle or email you provided to me. If you're contacting me without a form, please reach out with the following information:

  1. Character references: Fully colored, visual references. Quality doesn't matter - this is for workflow ease. I will not work with written descriptions, collages that aim to frankenstein the character, or do any character design work without proper compensation.

  2. Commission type: Style, framing, and/or number of characters involved.

  3. Composition details: Poses, expressions, actions, vibes, backgrounds, colors, etc. References can be written or visual (pictures, moodboards, etc.).

  4. Any additional information. Included but not limited to character lore, personalities, external links (toyhouse, google drive, artfight, refsheet, etc.), keywords/themes for the characters or piece's atmosphere, music, moodboards, etc.

  5. Deadline. If you don't have one, you don't need to provide it. I won't work with deadlines shorter than 1 month unless my rush fees are available at the moment (ask; see here).

  1. 1 to 3 thumbnails/rough sketches will be sent in an approximate average of 1, to 7 days after your request has been approved. You can ask up to 3 free major changes/full reworks in this stage, including but not limited to more pose/composition options. Any more changes and/or options desired after that will have a negotiable fee.

  2. After the initial sketch/thumbnail has been approved, I will ask for your paypal email so as to send you an invoice. I won’t continue working on your order until the full arranged payment has been sent.

  3. Within a previously discussed timeframe, I will send a lineart + base color preview for you to approve. Small changes such as in color or details can be made for free in this stage.

  4. No more free major changes can be made after the lineart + base color stage. After that, the repair fee will apply. The fee starts at $5 USD minimum and may increase depending of the complexity of the repairs. It can be applied at any time, multiple times during the commission process.

  5. Once all changes are approved, the commissioned Work will proceed to completion, either with rendering or cleanup, depending on the style that's being worked on.

  6. Once the commissioned Work is finished, you will receive a high-resolution image (usually .png, unless requested otherwise) through file sharing services such as st.ash, Google Drive, email, etc.

  7. The commissioned order may be cancelled at any time before or after the sketch stage, regardless of if the payment has been completed, though if it has, no refunds will be made (see III - F).

Once you, the Client, have placed your order with me, the Artist, these clauses will automatically apply to both parties, even if you do not read these terms. By working in a commissioned piece with me, the Artist, you, the Client, will be taken as having agreed and consented to my terms of service.


WHAT I WILL DRAW

  • Your human, kemonomimi, fan, DnD, etc. original characters; any race, age and body type.

  • You, your loved ones, your favorite characters.

  • Shipping, including oc x canon, oc x oc, canon x canon, and crack/joke ships.

  • Friendships, platonic and romantic relationships (mono and poly alike).

  • Backgrounds and perspective-centered poses.

  • Group shoots.

  • Anthropomorphic characters/furries.

  • Ponies, animals, pokémon, fantasy creatures.

  • Realism/semi realism.

  • Light violence, including fights, death, and pieces of a generally darker nature.

  • Light gore, including bruises, bloodstains, freshly severed limbs, body horror, and cuts.

  • Feel free to ask!

WHAT I WON'T DRAW

  • Extremely detailed mecha, though it may depend. I will usually agree to drawing characters with stylized robotic bodies/limbs like Edward Elric (FMAB) or Mettaton (UT), for example. Please ask.

  • Extremely detailed/maximalist backgrounds.

  • Extreme gore.

  • Harmful content. Including but not limited to p/dophilia, racism, sexism, lgbtphobia, etc.

  • Ship/lewd art involving public figures/real life people without their rightful consent.

  • Anything that makes me uncomfortable, really.

BLACKLIST

No one listed here may purchase anything from me in any way nor own my designs. A brief summary of the situation that lead them to this list will always be available publicly - if necessary, more details and proof may be provided in private. If you find yourself on this list and are willing to resolve the issue in good faith, contact me privately - if not, refrain from doing so, as then I have no interest in further interacting with you.

  • Kuromi Winslow (Facebook): Ordered two sketches, then found themselves busy with personal matters for a few weeks, putting their order on hold, which I understood. After I sent the invoice by their demand, they blocked me. Needless to say, payment was never provided.

  • deconaire/dev0deco (aka. eunbrella, Sasha, Sunny): Stalked me and heavily referenced, bordering plagiarizing, my characters, projects, and general work for months on end (all of which they admitted to doing, to me and other mutual acquaintances, via private messages).
